CHARLOTTE, N.C. (AP) — A judge has declared a mistrial in a case against a one of three men accused of killing two people in 2011.
The Charlotte Observer reports (http://bit.ly/2ci9aWu) the Mecklenburg County District Attorney’s Office said Thursday that jurors indicated they were unable to reach a unanimous verdict in Efrain Tzompaxtle’s trial.
Twenty-eight-year-old Tzompaxtle of Charlotte was among three suspects facing murder and armed robbery charges in the deaths of 39-year-old Benjamin Acahua-Itehua and 32-year-old Floriberto “Roberto” Acahua-Itehua.
Police said Tzompaxtle roomed with the victims at a Charlotte home, where they found blood and evidence of foul play. The victims’ remains were found near a field in Florence County, South Carolina in November 2011.
Court records show 25-year-old Aquilino Tzompaxtle and 31-year-old Dominick Vershon Cole remain jailed. Their trials are pending.
