Fired firefighter makes claims

A former Rockingham fire fighter and the mayor pro-tem of Rockingham shared their respective sides of the story of how the fire fighters came to form a union, and subsequent events.

Now that Rodney Gandy is no longer a member of the department, he said he feels he can share the experiences of he and his fellow city fire fighters.

“The money wasn’t the reason behind this,” Gandy said. “It’s a control issue. We’re frustrated because even when you’re off, the chief still tries to control everything you do 24 hours a day, seven days a week.”

He recounted working conditions including profanity-laced tirades, objects thrown in anger, trash cans kicked and overturned.

The fire fighters formed a union chapter late in 2008, and filed suit against the city for overtime compensation in March.

All 10 members of the union were listed as plaintiffs in the lawsuit. There are two fire fighters who haven’t chosen to join the union, and the three officers of the department haven’t either.

Gandy also addressed allegations in a press release sent out by the International Association of Fire Fighters Wednesday.

“They’re all true,” he said.

City Manager Monty Crump said the first time he knew there was any question was when the lawsuit was served.

“We have a grievance process to go through over workplace conditions and disciplinary actions,” Crump said. “When a policeman or a firefighter or a city employee is hired, there’s an orientation process, they receive a personnel ordinance and everything is explained to them.”

He said the City of Rockingham has filed a response to the lawsuit, and it is the city’s contention it has been in compliance with the Fair Standards Labor Act since August 1985.

“We’ve paid police and fire fighters the same way for 24 years and there’s never been a question before,” he said.

Crump as well as Rockingham Mayor Pro-Tem Bennett Deane noted officials can only go so far with a statement due to pending litigation.

“Until the article ran in the Daily Journal, speaking as a city council member, I was totally unaware of any of the concerns these guys have filed the lawsuit over and the grievances they have,” he said.

Deane said it was disappointing for him to find out what these employees have to say in this manner.

“I just feel like we have a system of open government, and I also feel all of our city council members are very approachable,” he said. “There is a formal process to go through to voice these grievances, and I find it hard to believe, in this small community, that none of them could speak to some member of council or management about this.

“We try to be fair to everybody, but now it’s in litigation and it will have to go through that process.”

Gandy also said under former chief Charles Trotter, fire fighters were encouraged to have a part-time job.

“The way he looked at it, you work 10 days a month and you only make so much money,” he said. “Everybody had a part-time job. We were encouraged to supplement our income.”

He said he was told he was on his way out before being fired, and informed he had to take his radio into church with him, after he missed two calls while there, and not to travel more than 45 minutes away from Rockingham.

“We were told we could only travel out-of-town for two hours,” Gandy said. “Since we joined the union, we’ve been told we can’t travel out-of-town at all.”

He said he understands structure fires don’t take time off, “but we thought when you’re off, you’re off.”

He said the fire fighters were also instructed if they tried to go over Gardner’s head and approach the local media or a city council member they would be terminated immediately.

IAFF Chapter President Robbie Barber said their union chapter did not believe any of their members would be fired.

“He fired Rodney and made a believer out of us,” he said.

He said he was instructed to only confirm or deny the information in the press release by union attorneys.

“It’s all true,” he said. “We had to fight to get that much out there. We’re concerned for our safety.”

As I said previously, I do support ALL of the fireman, not only Rockingham but all fire departments. I have the utmost respect for anyone who is brave enough to go into a burning building to save someones home or life. Again, the atmosphere & attitude at the station has changed drasticly since the guys decided to join a union. I support all 12 guys, but they both are entitled to freedom of speech, however, I feel the union enables them to be able speak about anything relating to the lawsuit, but doesn't enable them from talking or being friends with each other. I hope all 12 guys support each other, as this can only help make the RFD better than what it already is. Again, my hope & prayers are that all of the fireman will be safe from harms way. Thanks again to everyone for their support of our local fireman!

I to am a firefighters wife. My husband is a union member. I don't feel this issue at hand is a matter of being a union or non-union, but a matter of everyone deserves the right to be heard and to share their opinion on the situation. I am a city taxpayer & I definetly feel that this is going to hit our pocketbooks to pay for defense of both sides. I hate that it has had to come to this point also, due to integrity of the dept. & the economic situation that our country is in at this time. These fireman are like family & spend more time together than with their own families. I also do not want people to think bad about the RFD, who has a remarkable history for response times, training/certifications, new equipment, a newly built training facility & much more that there isnt enough room to type it all out in this note, however, all of this information is public information and is available at city hall if any of you would like to view. Most people know all the fireman personally and know that most of them have been with the city for 16 yrs plus except for a few new guys. I am not at the station to witness behaviors everyday either however, I have spoken with several fireman whom say that the 2 non-union members have not been speaking to them & have made rude comments regarding the other fireman exercising their right to join a union. I'm not saying I am for or against a union either, but obviously my husband felt at this point it was necessary to protect his job. I truly believe all of the guys are dedicated to their job & they do lay their lives on the line everytime the tones go off & they put their turnout gear on & head off to the scene, not knowing what it will truly involve until they arrive there. There is always a possibility that they may never come out of the burning structure alive. I believe all of these guys are safe & truly know how to do their jobs & your fellow fireman, whether you agree or disagree on certain subjects, could be the one to save your life should the unexpected happen. I pray that this never happens. I worry everyday, that all of these fireman put their lives on the line, to protect the citizens whom they took an oath to uphold. Should tragedy strike this fire dept. their is a great possibility that it could be my husband. I cannot or do not want to even fatham my child growing up without a father or me being a widow, should this happen. There isn't enough money in 401-k's, social security, firemans relief funds or life insurance policies that could supplement how much my husband means to me & my family. So readers please support your fireman, but more importantly pray for them & that God will place of hedge of protection around them & keep ALL of them safe always! May God bless each & everyone of you! Thanks for all you do for the City of Rham.

Taxpayer,

I am not a witness to ANY FIREMAN's behavior on the job so I cannot defend anything for anyone there. Which is why I reposted about not tarnishing the image of the department by the negative comments about the department as a whole. Union or not they ALL stand side by side and lay their lives on the line daily and I listed a few things taxpayers have benefited from by having the Rockingham Fire Department.

I also believe wholeheartedly and know for a fact that my husband or *in your words* "the spineless, little half wit" would help you if you ever needed it, regardless of your thoughts of him. His choice not to join doesn't make him a (per your words throughout articles) "brown noser" or "spineless little half wit".

Member or non-member these men will still show up to answer your call, including my husband.

Talk about an insulting individual??? You called me insulting, do you review your own words? I have nothing to prove to you or anyone here. I have an opinion, I spoke it, just like the rest of you. As for me being a non-union member, I am a member of the UTU and have been for the last 13 years. I never ONCE said they should not be a union. I have a problem with a lawsuit being filed based on getting wages improved and then members coming out saying "it's not about the compensation" long before it hit the newspaper. That makes other unions look like all we want is to get the big dog. You can't strike in NC as a city employee but with all the complaints about the chief's attitude and actions you can file a lawsuit for breach of safety. Ever heard of devil's advocate? Nothing I have said here will not be said or asked of us Rockingham citizens or those firemen in court. I have been there done that!

This particular scenario has to do with many things; 1) More money, (2) they are more intersted in principal, honesty & respect for one another. It is a neccessity without all 12 fireman, chief, asst. chief, & secretary. What if they would go on strike, should it come to this!The spineless little half wits who dont' speak & are not union members are dogging these other guys, they didn't force them to join, they were asked off duty, if they would like to join & IAFF association but they elected not to, howver, from what I understand they will still get the same compensation package, for being in violation of the labor Laws. The true spineless little half wits have gone to Chuck Gardner relating to this & they were told if they went above their chain of command that they WOULD BE FIRED!!!!! I don't see anyone crying & whining but you, and NO IT IS NOT OVER BY A LONG SHOT & NO WE the citizens & hopefully the fireman going to give up on supporting these fireman & I hope & know they have the backbone to stand up to Chuck & refuse to allow this situation to escalade.

Also, why does it have to be the boys lieing? We haven't heard chuck, monty or city halls defense. Who said that Chuck cannot be proven wrong? Also ask around the city & see how many fireman, police officers, ECOMM dispatchers & bosses, Forestry services, paramedics & his own son. THe paper states that the fireman & others are llimited to what & whom they can tell their side to as to how they have been cursed & threatened!

I guess Chuck Gardner must believe that it would be cheaper to hire & train 10 new fireman & be non-union & continue to let him dictate what you can & can't do. I don't believe for one minute that them boys need anyone telling them what they need to do, they have all been employeed there long enough to know what & how to do it, depending on the chiefow much we the taxpayers home are having to defendd this lawsuit.

Yes, this particular FD is staffed by men, however, local surrounding Fire depts. have firewomen also!

Yes it takes much courage to put your life & your families future on the line to take on a Fire Chief & City Manager who without a doubt are in this thing together & they both know SOMETHING ON EACH OTHER. Due to the lack of evidence given to the taxpayers thus far, I do not feel you fireman have a choice but to stand united as one & hold these individuals accountable for their actions. However, from what I understand about unions, won't the 2 non-union members get the same compensation that the other fireman will recieve? Each of you fireman, I believe can hold your head high & know that the TAXPAYERS who are & will be paying for this settlement once u go to trial. What jury in their right mind would go against 10 dedication union fireman vs a bipolar fire chief? The taxpayers have your back, as you have had some of ours in different scenarios.

Dana I still don't believe the railroad spill. I believe concerned is one of the non-union members of the RFD, which isn't a problem, however, he is a big, spineless fireman who has to hide his identity b/c, he is a yes sir person!!! U are right, these fireman should not have to work 2 or 3 jobs to provide for their families. I know I could not & would not begin to fatham going into a burning structure & risking my life on the line for what they are pain, it's pitiful. What is even sader, is, they are having to even fight for that! I to have spoken with members of the railroad & almost everyone there is a member of the union. I continue to pray for not only all the fireman, but the citizens who are having attempt to defend these fireman who have not done anything wrong, except stepped on toes & opened up eyes & doors!!!

I don't feel that this is any way tarnishes the reputation of the RFD. Nothing has changed at the fire dept except the fireman are asking for fair compensation & to take the bipolar chief out before he goes postal on no telling how many individuals or when he may attack. He is a true snake in the grass. If you can prove his behavior otherwise, we're all ears listening for your defense...

Right is right and wrong is wrong. I agree the Fire Department's reputation shouldn't be tarnished, but Chief Gardner shouldn't be allowed to continue acting like a psychopath without answering for it. I don't believe calling one person out on their insane behavior is tarnishing to the reputation of the Fire Department.

How many times do you leave your full time job at the railroad to answer a fire call? Also, if you work for the railroad, aren't you a union member? And while we're at it, let's talk about pay... it's really easy to sit back in judgment when you're making plenty enough money with one job! Our firemen shouldn't need any other job, because we should pay them plenty! Same thing goes for the police, the teachers, etc... those who serve our community on the highest level and those we depend on for our future the most .... are paid the least!

You do have the right to your opinion, and you can do so without acting like the man in question! The entire issue is about what is right and what is WRONG.... and the way Chief Gardner is acting and has a history of acting is WRONG. He shouldn't be in any position of power with his history of violence and abuse of power! I pray God will change is heart, and reveal to him the error of his ways.

One more thing, concerned, why the need to hide behind a screen name?

Amen,taxpayer! the facts speak for themselves if one of the lowly "untitled" other city employed acted like the city manager and chief they would have been esorted to the door long ago. It seems the elite upper managment types always slide by as if they were made of teflon! Our city manager, who hired this throw back to the 1950's type of dept. head works for the city council, he has controversy surrounding him as well. The city paid him $42,000 in 1997 to go away! And now he is still HERE! calling the kettle black! now, here are the firefighters, asking for just compensation, beging treated like they were the taliban! It's time for the taxpayers/voters to change the old guard! thats what has got to happen and happen soon!

Rodney Gandy = Dedicated, Honest, Dependable, Hardworking, Pleasant, Law-Abiding, etc.

Chuck Gardner = Bully, Untrustworthy, Psychologically disturbed, unpleasant, Law-Breaking, rude, unapprecaiative, etc.

If either of these two names are mentioned in the public, What are your true descriptions of these individuals past, present & future characteristic traits???

They are ALL still answering calls for the citizens of Rockingham and those outlying cities that require mutual aide, regardless of the suit filed.

Whether or not you agree or disagree, these men risks their lives. ALL OF THEM not just those 10! Those 10 are not the entire staff!!

Look at what good is being done. Rockingham has decreased family displacement due to less damage, property saved, a Child Safety Seat Checking Station, they have had a 0 safety accident rate over the last couple of years, their response time is phenominal. These guys are certified in all aspects of their training PART TIME and FULL TIME firemen. They have built a training facility in their own back lot...etc....

These are 10 of the firmen. Let this play out the way it needs too, the way these 10 have asked...IN COURT! Do not tarnish the image of the Rockingham Fire Department.

For those of you criticizing them, saying they sit on their butt....we all have days on our job where it is not busy, but how many of us risk our life each time the tones go off? I'd say not many of those criticizing this department.

It is easy to sit back and criticize without knowing the full truth. Look at how much money is saved for taxpayers by having the response time and training of these firemen....Less families being put out of their homes due to damage, less financial aide needed from the American Red Cross to assist those families, prevention education being provided from preschool on up!

Regardless of the lawsuit, my husband lays his life on the line daily and I don't calculate that by an hourly wage...their is no amount of money that can supplement what my husband means to our family.

I am a wife of one of the non-union members. All I want to say is that I pray for each and everyone of the firemen daily. I continue to have good relationships with each of them and this lawsuit does not change my behavior towards them.

I have sat quietly back and read all the post and am compelled to say that because my husband is not a union member doesn't mean he is one of two brown nosers. Myself and my family support the Rockingham Fire Department personnel AS A WHOLE.

I do not live in Rockingham so I do not pay Rockingham taxes, but I do think and believe whole heartedly that the Rockingham Fire Department has a good name and reputaion. I hate seeing it being played out in public this way. In this time of anger, high emotions and hurt I hope the good deeds of the department do not get lost in the turmoil.

The last time I checked the fire department was staffed by firemen, not firewomen, except for the secretary, therefore my spouse can't be a member of the fire department since I am a man.

I actually do volunteer my time as a firefighter when not working at the railroad. Anything else you need clarification on?

As for calling me an insulting individual, I've done nothing that the rest of you in this forum haven't done. You all say insulting things about the City administration, what's the big deal that I choose to support Chief Gardner and the City until proven otherwise. Since I am a taxpaying Rockingham citizen I get to have an opinion.

Oh yeah, I don't get $16 for attending a fire call, there is no compensation hence the word VOLUNTEER

To all of the fireman & their families who are involved in this retaliation, remember your oath & the prayer that u were sworn to take as you accepted this job.

Lord, guide me through the fire & make my pathway clear; as I rescue those in danger may I have no fear. Although the flames surround me, I know I'm not alone, for you are right beside me, for you never leave your own.

To all of the fireman God's word promises he will NEVER leave you or foresake you. Always, remember you can do all things in Christ who gives you strength. Even though Chuck Gardner believes he is GOD, the one & only true GOD remains in control 24-7!

In response to Pyro-k9, I agree with you & have a great deal of respect for these fireman who WILLINGLY put their lives on the line to serve our community. I have also verified your accusation that Monty Crump said that he supported EVERY decision that Chuck Gardner made. This is very sad, but I have found it to BE TRUE!!! The city says they have an "open door policy", this sounds good, but DO THEY EXERCISE THIS RIGHT WITHOUT BEING PENTALIZED??? It was told to me that the mandatory meeting that was called was due to a fireman writting an anonymous letter to the mayor, who in turn, gave it to Monty Crump to follow up on. The mandatory meeting was called & the staff was told that if he found out who the "chicken" was who went over his chain of command & sent the letter to the mayor, that HE WOULD FIRE THEM!!!!

To Concerned '09 who isn't the Rham Firefighters unions niece or president, but I believe to be the spouse of one of the two of the non-union members of the RFD. Yes, there very much are two sides to every story & what I have heard thus far has written or verbal proof. This indeed is is the talk of the town. The sad part is one thing ALMOST everyone agrees to is Chuck Gardner in not a people person at all & should have never been placed in this type of strenousjob environment. I think the fireman of RFD have done a fine job for 18 plus yrs while they have served our city. The fireman do love their jobs of saving homes & lives. Concerned '09 you also want to dog the full time fireman, which your husband is one Is it unrealistic to expect an individual to be available 24-7 with NO TIME OFF FOR PERSONAL reasons. You also know there used to be a log in/out sheet for when these men were unavailable, however, when this legal issue of being on call & not being compensated was brought up, this sheet disappeared & if you don't make every call you would now be written up or fired. Since you have so much free time on your hands & you say that there are men & women to VOLUNTEER their time without compensation why don't you step up to the door & go into a burning house for $16, maybe to be paid or not paid depending on the chiefs mood for the day. You can take up for your brown nosing husband & yes if it's your family's home on fire or your family that need to be cut out of their vehicle, yes the DEDICATED FIREMAN will still respond, even to insulting individuals like you!!!!!!!!!!

Chuck Gardner can only bully, browbeat and threaten for so long before it all comes out publicly. I hope the city council members will take his previous history into consideration when reviewing the complaints of these honest fire fighters.

You see that's the thing with the truth, it always comes out no matter how many times you bury it. I don't see the point in hiding who I am on these forums, because I'm not ashamed of my beliefs and I'm certainly not afraid to stand up for what is right. City Employee, if you have nothing to fear, why the hiding behind a screen name? Could it possibly reveal you to be the relative of the chief? Maybe the angry apple didn't fall very far from the angry tree!

If these men had any other way to resolve working in a hostile work environment, I have full confidence they would have. It's not a coincidence that all the men suspended or fired were part of the union, and it's not a coincidence that all the men picking up the overtime slack are the ones that cowered down to the chief and played the game. If anyone is spineless, it's the members of the fire department who are using this issue to try to work their way up the ladder by kissing butt!

Also, it's not a coincidence that Chuck Gardner is again being accused of threats and violent behavior. Call me crazy, but I don't think the fire fighters and the assaulted contractor conspired to take down poor, innocent Chuck Gardner just for the heck of it!

Again I'll say, the Rockingham Fire Department did not have these issues before Chief Gardner! THAT IS NOT A COINCIDENCE!

See, you can only go around making threats and abusing power for so long before you ANSWER for your actions! The person that needs to be suspended without pay pending investigation is CHIEF GARDNER, especially considering his previous history of VIOLENCE!
