State seeks death penalty in child murder case

An application to seek the death penalty in the case of Julius Juan Lilly has been filed by the District Attorney’s office, according to court records.

The 39-year-old Ellerbe man is facing charges of first degree murder and felony child abuse inflicting serious bodily injury, in the September death of his girlfriend’s daughter, 4-year-old Reba Lynn Marie Ryan.

According to court documents filed by the Richmond County Sheriff’s Office, an acquaintance of Lilly’s told investigators that she received a call from Lilly on Sept. 28 asking her and her boyfriend to come to his house because something was wrong with Reba. She said Lilly told her he had “whipped” Reba and that the child would not get up, lawmen said.

A detective’s narrative from the court records said that once Lilly was taken into custody, “he admitted to striking the child.”

An Oct. 11 court document requested a pre-trial conference for Lilly in which the state will seek capital punishment in the case.

The document, signed by prosecutor Dawn M. Layton, said that Lilly “has been indicted for first degree murder and felonious child abuse inflicting serious bodily injury, which is a crime punishable by death, and Rule 24 mandates a hearing in such cases.”

As part of the application, the state references N.C. General Statute 15A-2004, which mandates that “the State, in its discretion, may elect to try a defendant capitally or noncapitally for first degree murder, even if evidence of an aggravating circumstance exists. The State may agree to accept a sentence of life imprisonment for a defendant at any point in the prosecution of a capital felony, even if evidence of an aggravating circumstance exists.”

The application for Rule 24 also requested that the court schedule the pre-trial conference within 45 days.

On Friday, Layton declined to comment on the case, and phone calls made to Lilly’s court-appointed defense attorney Richard Culler were not returned.

The court files show that Lilly’s next court appearance will be on Nov. 13 in Superior Court.

I knew this man or at least I thought I did, guessin he sure fool me. Never in my mind would I think he could do something like this, but u really don't know people outside of work. I saw Reba a couple of times,beautiful lil girl. No matter how mad u get u should never ever do a child like that,defensive,... Children are from god!!! I honestly have to say,he deserves everything he gets,pluse some. Juan make god help ur soul, cause u gonna need it. R.I.P LIL ANGEL. He can't harm u anymore! And Reba' s daddy, keep ur head held high, and through all the tough time. God will see u through it all,just pray ans seek god!

I am appalled that someone would say "yes the man done wrong", it's not like he busted out a car window, He brutally murdered a BABY!!! WHAT ABOUT THAT DO YOU NOT UNDERSTAND. We keep up prisoners every day and to afford them luxuries that most of us can't even afford to me seems a reward for such a heinous act!! Maybe you'd feel differently if it were a child in your family. I say LET HIM FRY!!! I'D FLIP THE SWITCH!!! Kids are defenseless against these monsters and I for one applaud our county's prosecutor for standing up and saying enough is enough. I think if someone hurts a child they should get life, but if someone kills a baby that can't defend him or her self they deserve no less than an agonizing death.

my comment is yes the man done wrong. But if you look back at all the murder cases in richmond county how many was put towards the death penalty? So why is they tryin to give this man the death penalty and the rest of the cases revolving round murder is just life and most of the cases 99% of the time just been life. This man should be treated the same as others.

Oh please... Save your energy and my tax money. Put him where he belongs!!!! You don't beat a four year old child to death and expect to live, do you??? He's a damn coward and he should be charged with larceny too cause he's an oxygen thief.. In other words A Waste Of Life!!!

How many of those same murder cases involved a 4 year old girl? How many of those murders were felony child abuse? How many were cold blooded baby killers? I want this man to rot in prison for the rest of his pathetic life. But I believe I will get more pleasure watching the life leave this miserable excuse for a human. Life in prison is a much tougher punishment than the death penalty when you think about it. Your still alive. You will never see the other side of humanity again. You have to life in the regret of your crime for the rest of your years. Death is a release from all pain isn't it? Isn't he actually getting off easy by them taking his life in compensation for my daughter? Put yourself in my shoes for a minute. What thoughts would your mind process if this waste of oxygen beat your daughter to death? My little girl is gone now because of this sadistic mongrel. I despise the fact that my tax money is feeding and clothing him at this very moment. Walk on the other side of the fence for a while and you'll see, some are deserving of life, some aren't.

The reason they is trying to give this man the death penalty is because he murdered a defenseless 4 year old baby, are you freaking kidding me???? OMG, it seems like now a days the older they get, the more ignorant they get!!! Just how many of the murder cases in Richmond County in the past, that did not get or even have the possibility of getting the death penalty, how many were cases of the murder of a 4 year old baby?? Geezzzz, How could anyone even think that way is beyond me!!! If it were your child or a child you love, you would be preaching a different sermon then!!! The faster he burns in Hell the better!!

Reba's Dad, My heart breaks for you!! The tears flow as I write this. I so understand how you feel, dying would put an end to his pain here on earth but the pain he will have in Hell he can never escape. To do what he did to your precious daughter, he will burn in Hell for eternity and the sooner the better, I say. He does not deserve to breathe, He took away Reba's right to breathe, he had no right. I pray that God gives you peace in your heart and in mine too because right now, I so despise this sorry excuse of a human being!!! Your baby girl in an Angel now and she will always be watching over her Daddy. <3 Sorry for venting, my heart does break for you!!
